Vacation Rental Contract
BEACHWALKER RENTALS TERMS AND CONDITIONS
Deposit/Payments - A one-third deposit is required upon the booking of your reservation. We accept Debit Cards, Visa, MasterCard, Discover and check. We also have the ability to process checks by phone using our secure online system. The remaining balance is due 30 days prior to arrival for villas and cottages and 60 days prior to arrival for homes. The due date for your payments is also printed on the first page of your Vacation Rental Agreement. If your remaining balance is greater than $2,000, final payment is due by electronic check, check or debit card on or before the final payment due date. Checks and electronic checks may not be accepted within two weeks of arrival.
Please Note: When making a deposit payment (or payment in full) to reserve a property, if by phone or on our website, you are agreeing to the Terms and Conditions within this document. The Terms and Conditions are emailed to you upon booking a reservation and are also posted on our website. However, a signed contract is required within 7 days of booking your reservation.
Checking In - To ensure each property is cleaned to our high quality standards, guests will not be given keys to accommodations until the property has been cleaned and inspected, which is typically between 4:00 and 6:00 p.m. A 1:00 priority arrival is available for select properties for an additional fee.
Checking Out - Check-out time is 10:00 a.m. This check out time is strictly enforced and late check-outs are generally not permitted (particularly in the high season). Should a guest stay past check out time without written permission by Beachwalker, a late check-out fee will be charged of $100 per hour for the first two hours and a full day’s rent for a late departure exceeding 2 hours. All keys must be returned to Beachwalker’s Freshfields office at check-out. Should a guest choose to depart prior to the departure date on their contract, no refunds or credits will be given for any unused portion of your stay.
Occupancy - We rent to adults over the age of 25 only. An ID must be furnished upon request. The guest is not permitted to have any type of large group gatherings, such as weddings, receptions or parties. Should Beachwalker find that a guest is misrepresenting themselves, the property is over occupancy, or is being used for such an event, we reserve the right to terminate this agreement and ask guest to vacate without reimbursement
Car Passes - All properties are limited to a specific number of security passes, based upon available parking spaces and maximum property occupancy. Parking on lawns or landscaping is not permitted by the island. Overnight parking on the street is not permitted by the island. Cars in violation will be ticketed and/or towed.
Maintenance – Should you experience a maintenance issue during your stay, every reasonable effort will be made by Beachwalker to remedy the issue within one business day of being reported. However, no guarantee can be made that such problems can be resolved immediately. The guest must allow a technician to enter the property in order to remedy the maintenance issue. No refunds, credits, or the option to move to another property will be given for breakdowns unless the property is not tenantable for more than 24 hours. Tenantable issues only include complete absence of water, electricity, heat, or air conditioning.
Property Availability - When the property reserved is no longer available for rent or is not tenantable due to unforeseen circumstances, excluding Acts of God, another comparable accommodation at Beachwalker’s discretion, will be substituted. If no substitute property is available, monies paid will be refunded pro-rata.
Damage & Damage Protection - Guest is responsible for any damage, abuse, excessive cleanup, moved furniture, loss or removal of property contents during Guest’s stay. Inspectors walk through each property after check out to ensure the property is left in good order. Guests will be notified of any additional charges. Vacation Rental Damage Protection has been included in your reservation and is designed to cover unintentional damages to the rental property that may occur during your stay. Any damage must be disclosed to management prior to departure. The protection will pay a maximum benefit of $1,500 on 1-3 bedroom properties, and $3,000 on 4 bedroom or larger properties. Any damages that exceed $3,000 or are not covered will be charged to the guest. Certain terms and conditions apply. Damage Protection does not cover theft or removal of property contents. In lieu of this Damage Protection, you may pay a refundable security deposit of $1,500 (for 1-3 bedroom properties) or $3,000 (for 4+ bedroom properties) any time prior to check-in. Please contact Beachwalker Rentals if you prefer to provide a refundable security deposit.
Furnishings - All properties are privately-owned and furnished and equipped by the Owner. Every effort has been made to ensure all descriptions are accurate. Beachwalker is not responsible for changes in furnishings, bed configuration and equipment made by homeowners, which are subject to change without notice. Neither Beachwalker nor the owner will be responsible for providing additional (or removal of) furnishings or equipment. All properties include central air conditioning, cable TV, a DVD player, fully equipped kitchens, and a washer and dryer.
Housekeeping - Your rental includes linens & bath towels, a departure housekeeping service, and a starter supply of paper products and detergents. Additional housekeeping or linens are available for a fee.
Garages – In most homes, garages are solely for the use of owners and unable to be used by Beachwalker guests.
Fireplaces– The use of fireplaces in a property is not permitted. A fine of $250 will be charged for cleaning and proper shut off by the gas company if unauthorized use has been found.
Pools - Pool availability is not guaranteed with any reservation. Some areas on Kiawah and Seabrook include the use of community swimming pools. Private pools are restricted to the use of guests staying at a particular property. Private pools are typically not heated. Guests staying on Seabrook may use the Seabrook Island Club and/or Lake House Pools. An additional fee may be required. All pools are swim at your own risk. The resort pools on Kiawah are owned and operated by the Kiawah Island Resort and may not be used by Beachwalker guests.
Grills - In attached dwellings, such as villas & townhouses, town fire code regulations prohibit grilling on decks and porches. Many homes have gas grills. If a gas tank is empty, Beachwalker will refill it during normal business hours or the guest may refill it and be reimbursed by Beachwalker.
Cable & Internet - Most of our properties offer cable and wireless Internet access as a convenience to our guests. Cable, wireless accessibility and Internet connections are not guaranteed. If cable or Internet service is out, we will make every effort to restore the service during normal business hours; however, a service call may be required to solve problem. No refunds will be given or money prorated for Internet access problems. Additional charges may apply for technical support needed due to issues not related to the property’s Internet access, such as guest’s computer error in configuration or guests resetting the modem. Purchasing any features, movies or shows is not permitted. Guest wil be responsible for a $10 fee in addition to the cost of purchase charges incurred.
Telephones - Landline phones are not guaranteed in all properties. Local calls are available in most properties that have a landline. International calls are not permitted.
Island Construction - Beachwalker Rentals is not responsible for noise or inconvenience caused by construction occurring nearby during permitted hours and abiding by island and/or regime ordinances. No compensation or reaccommodation will occur.
Lockouts – Please take care to keep your keys with you when leaving your rental property. In the event of an accidental lock-out, $100 will be charged after office hours when a Beachwalker representative meets you. Travel time for on-call Beachwalker representatives frequently exceed one hour.
Lost Articles - Neither Beachwalker nor the property owner shall be responsible for any lost or stolen items or for items left at a property upon departure. This includes but is not limited to money, jewelry, electronics or other personal items. There will be a charge of $25 in addition to shipping charges for any lost and found item shipped to Guest upon request.
Pets - Dogs with certain weight and breed restrictions are permitted in certain “pet friendly” properties for a non-refundable pet fee of $25 per day per dog with a limit of 2 dogs. Guests are responsible for any and all damages caused by their dog. If any damage exceeds the amount of the pet fee paid, guest will be notified and charged for additional damages. Pets found to be in properties (either during or after your stay) not designated as “pet friendly” or who have not paid the pet fee in “pet friendly” properties may be asked to vacate the property and will be charged one day’s rent in addition to the pet fee.
Because properties are privately-owned and not public buildings, service dogs and therapy dogs are subject to this clause as well.
Smoking – All of our properties are non-smoking. A fine of $250 will be charged for additional cleaning if evidence of smoking has been found inside a property.
Allergies – No compensation or change of accommodations will result for any allergic reactions due to pollen, animals, environmental conditions, cleaning products, or personal allergies.
Island Covenants – Guests must be sufficiently quiet as to not disturb other guests or property owners. Quiet hours (11:00 p.m. to 7:00 a.m.) are strictly enforced by island security.
The operation, use and storage of RVs, campers, utility trailers and watercrafts, motorcycles, motorized scooters and jet skis are not permitted on the islands.
Island Covenants and Restrictions prohibit hanging clothes or towels from railings. No objects (coolers, bikes, floats, etc.) may obstruct or be stored in stairways, walkways, driveways or other common areas.
Hold Harmless – As a guest of Beachwalker Rentals, you agree to hold harmless the company and the property owner from any accident or injury that may occur on the premises during your stay.
Deposit Interest Disclosure – In accordance with SC Real Estate Commission regulations, all reservation deposits are held in escrow in a bank chartered in the State of South Carolina. Interest on these funds accrues to the benefit of Beachwalker Rentals.
Payment Account on File – Beachwalker Rentals will charge your payment account on file for charges incurred for any of the above contract items.
Cancellation Policy - Should you find it necessary to cancel your reservation, your deposit will be refunded less a minimum cancellation fee of the greater of $100 or the reservation fee. All money on deposit will be forfeited if you cancel within the cancellation period unless the property is rebooked for the same dates and rates, or a guest has purchased travel insurance and has an eligible claim. All cancellations must be received in writing via email to firstname.lastname@example.org. Changing a reservation, either the accommodation or dates, constitutes a cancellation and the same terms and conditions apply.
Acts of God - “Acts of God”, including hurricanes, flooding and evacuations are not the responsibility of Beachwalker Rentals. No refunds will be given for missed stays or unused nights. We strongly recommend adding Travel Insurance to your reservation to protect your stay.
Travel Insurance - Guest Protection Plan. CSA Vacation Rental Insurance has been offered with your reservation. Vacation Rental Insurance reimburses for pre-paid, non-refundable expenses due to certain unforeseeable circumstances that may jeopardize your vacation and force you to incur unplanned expenses. Travel insurance may be added to your reservation up to and including your final payment due date.
